Miguel Angel Vasquez appeals the District Court's1 dismissal of his petition for a writ of habeas corpus under 28 U.S.C. § 2254. Vasquez contends that the Court below erred in refusing to consider the merits of his ineffective assistance of counsel claim and in dismissing his claims based on insufficiency of the evidence and denial of his right to effective cross-examination of an adverse witness.
