The appellant, Paul Edward Murry, was indicted for the capital offense of the murder of Mary Pearl McCord, a police officer, while she was on duty, or because of some official or job-related act or performance of Officer McCord. Ala.Code (1975), § 13A-5-40(a)(5). His first conviction and sentence of death for this offense were affirmed. Murry v. State, 455 So.2d 53
