Defendants David Harris ("Harris"), Michael Egger ("Egger"), Clement Capuano ("Capuano"), Fred Royce ("Royce"), and Thomas Maile ("Maile") (collectively the "defendants") have moved for summary judgment pursuant to Rule 56, Fed.R. Civ.P., and have moved for an order directing that any trial be conducted by the court without a jury.
