This declaratory judgment suit was filed by several Tastee Donut, Inc. franchise owners. They were unhappy because the parent corporation required them to pay an extra two per cent of its gross sales if they chose to sell small hamburgers called Kastleburgers.

The trial judge ruled in favor of Tastee Donuts, saying that the small hamburger program was not a part of the original franchise agreements and that the parent corporation could require...
