JONES, Justice.

Defendant appealed his conviction for driving under the influence of intoxicants (DUII) to the Court of Appeals, contending that the trial court erred in denying his motion to dismiss the charge on the ground of collateral estoppel. The Court of Appeals affirmed defendant's conviction. 85 Or.App. 237, 736 P.2d 570 (1987). We affirm the decision of the Court of Appeals.
