KLIEBERT, Judge.

Christopher Ware, defendant, was charged with two counts of violating LSA-R.S. 40:967 A-1, distribution of a Schedule II controlled dangerous substance, to-wit:

Cocaine. A jury found him not guilty of one count and guilty of attempted possession of a controlled dangerous substance on the other count. He was sentenced to three (3) years in jail and fined $3,000.00.
