Defendant, Chester Bennett Sr., was charged by bill of information with driving while intoxicated, third offense, in violation of La.R.S. 14:98. Following a guilty verdict rendered by a jury of six, defendant was sentenced as a habitual offender to serve 10 years at hard labor.
