As an insured under a group health policy, Wendy Carmouche brought suit against Continental Assurance Company for medical expenses, and penalties and attorney fees. The trial judge awarded all three, and the insurer appealed. Carmouche answered the appeal, seeking an increase in attorney's fees and urging that the trial court erred in considering the deductible under the co-insurance provisions in determining the amount of her recovery.
