Plaintiff, Joseph R. Bernard, sought worker's compensation benefits for total permanent disability, statutory penalties and attorney's fees, for a work-injury on December 1, 1982. Suit was filed on April 23, 1984. The case was tried before a magistrate by joint stipulation. At the conclusion of the trial the magistrate maintained a plea of one year prescription, which had been referred to the merits, and dismissed the suit. Bernard appealed. We reverse...
