Defendant Ridge G. Legendre appeals his conviction by the trial judge for second degree battery and the imposition of the maximum penalty of five years at hard labor. He asserts two assignments of error: (1) That there was insufficient evidence to find him guilty beyond a reasonable doubt and (2) That the penalty is excessive.
