We granted this writ to test the correctness of the trial court's action in denying a motion for summary judgment. Defendant Chicago Insurance Company (hereinafter "Chicago") filed the motion seeking summary judgment on its reconventional demand for a declaratory judgment. Because we conclude that there is no genuine issue of material fact and the mover is entitled to judgment as a matter of law, we make the writ peremptory, grant the motion, and remand...
