A. Copeland Enterprises, Inc. appeals from a judgment of the district court which granted plaintiff Donna Austin's motion for partial summary judgment, decreeing that, at the time of this accident, defendant driver Joseph Pascarelli was acting within the course and scope of his employment. We reverse the judgment of the trial court and remand the case for further proceedings not inconsistent with this decision...
