This case involves forced pooling under the Mineral Interest Pooling Act, Tex.Nat. Res.Code Ann. § 102.001 et seq. (1978) (MIPA). Appellees had offered to pool their oil interests with an adjoining landowner's and had been refused. They then applied to the Railroad Commission for a forced pooling order, but the Commission concluded that their voluntary offer was not "fair and reasonable" and dismissed the application.
