Martinez, appellants, brought suit in district court seeking to recover statutory penalties on an allegedly usurious note, and alternatively, for damages grounded in tort and contract. Corpus Christi Area Teachers Credit Union, appellee, thereafter filed suit in a county court at law seeking a deficiency judgment after appellants defaulted on the above note.
