Third-party defendant, First Acadiana Bank (FAB), appeals from a judgment rendered against it and in favor of third-party plaintiff, McGoldrick Oil Company (McGoldrick).

In January 1985, McGoldrick entered into an oral agreement with GDL Construction Company (GDL) pursuant to which GDL agreed to perform repair work on a bridge. The bridge traversed a small canal and connected two links of a private road accessing an oilfield operated by McGoldrick...
