This action for damages for personal injuries to the plaintiffs as guest passengers in a motor vehicle operated by the defendant in Indiana asserted negligence, but not wanton or willful misconduct. All parties were residents of Ohio.

The Court of Common Pleas of Mercer County sustained a motion for summary judgment in favor of the defendant based upon the guest statute of Indiana.
