BENAVIDES, Justice.

This is an appeal from a conviction upon a negotiated plea of guilty to the offense of murder.

Initially, appellant, Luis Garcia Rodriguez, was tried upon an indictment which charged capital murder, murder, and felony murder. The jury found the appellant guilty of capital murder and assessed the death penalty. Thereafter, the trial court granted a new trial because of discovered jury error in the punishment stage.
