In this appeal, we must determine the standard for imposing civil liability under the Motor Vehicle Information and Cost Savings Act (the Odometer Act), 15 U.S.C. § 1981 et seq. The Odometer Act and the regulations promulgated under its authority require a transferor of a vehicle to disclose accurately the vehicle's mileage.
