OPINION

BROOKSHIRE, Justice.

Appellant was found guilty by a jury of the offense of driving while intoxicated. The trial court set punishment at a fine of $500.00 and confinement in the County Jail for two years, probated for a period of two years. Appellant filed a timely motion for new trial.
