ERVIN, Circuit Judge:

The Greenesboro News & Record, Inc., ("the newspaper") was adjudged guilty of committing unfair labor practices by the NLRB because of incidents involving three employees at its Greenesboro, North Carolina plant. On September 19, 1984, the Board ruled that by discharging James Roberts on September 28, 1982, the newspaper violated sections 8(a)(1) and (3) of the NLRA, as amended, 29 U.S.C. § 158(a)(1), (3).1
