Manuel Lira, appealing from a judgment of conviction of two counts of Rape in the First Degree, asserts the Circuit Court of the First Circuit erred in refusing to instruct the jury on the effect of the complaining witness' consent to the conduct alleged and in denying the motion to dismiss the prosecution on the ground that his right under the state and federal constitutions to a speedy trial was violated.
