KELLEHER, Justice.

The defendants, Richard B. Tooher (Tooher) and Bruce N. Binns (Binns), are appealing from their convictions by a Superior Court jury. Tooher was convicted of obstructing justice and conspiring to obstruct justice. See G.L. 1956 (1981 Reenactment) §§ 11-1-6 and 11-32-3. Binns was convicted of the same charges as well as assault and battery. The charges arose out of incidents that occurred while Tooher was the police chief...
