CARROLL, Justice.

The prior opinion handed down by this Court on May 4, 1988, is withdrawn and the following is substituted therefor.

Both appellants were charged with criminally negligent homicide and pleaded nolo contendere to the charge after argument on pretrial motions. The trial court accepted the pleas and found both appellants guilty. We will reverse the judgments of the trial court and render judgments of acquittal...
