The plaintiff-appellant, Neal Roland, appeals from the district court's order granting summary judgment to the defendants-appellees. Roland also challenges the court's award of costs to the defendants. For the following reasons, we find that the court erred in its grant of summary judgment. Thus we reverse and remand this case for further proceedings consistent with this opinion. In addition, the court's award of costs to the defendants...
