I. Introduction

Presently before the Court is the motion of the defendant AT & T Technologies, Inc. ("AT & T"), for summary judgment against the plaintiffs in Civil No. HM-83-1399, David Conolly and Samuel Lamont Turner. Civil No. HM-83-1399 has previously been consolidated with Civil No. HM-80-2733, in which Conolly and Turner were also plaintiffs.
