This matter is before the court on defendants' motion for summary judgment. These consolidated cases arise out of the injury of two ironworkers on a bridge construction site in Kansas City, Kansas. A piece of rebar the two workers were handling came into contact with a power line owned by the defendant Board of Public Utilities ("BPU"). Plaintiffs suffered physical injury as a result.
