EHRLICH, Justice.

David Gorham was arrested by Pompano police and charged with the murder of Carl Peterson. He was tried and found guilty, but a mistrial was declared before sentencing. On retrial in October, 1982, Gorham was again found guilty of first-degree murder and attempted robbery and the jury recommended a life sentence. The judge overrode the jury recommendation and imposed the death penalty and a fifteen-year sentence for attempted robbery. The convictions...
