Linton Jacobs was jury convicted of driving while intoxicated, § 577.010 RSMo 1986, as amended, and, after being adjudged by the trial court to be a persistent offender, was sentenced to five years' imprisonment.

On appeal, Jacobs contends that the trial court committed reversible error by holding an ex parte conference during trial with the principal witness for the defense, following which the witness declined to testify further...
