In this lawsuit premised on the fourteenth amendment to the U.S. Constitution, as enforced by 42 U.S.C.A. §§ 1981, 1983, and on 42 U.S.C.A. §§ 2000e through 2000e-17, popularly known as Title VII of the Civil Rights Act of 1964, as amended, plaintiff Theodis Stokes successfully charged that defendant City of Montgomery, Alabama refused to promote him because he is black.
