VAN GRAAFEILAND, Circuit Judge:

D.R. Penny appeals from a $25,000 judgment of the United States District Court for the Northern District of New York which followed a jury trial before Judge Gagliardi. The judgment, in favor of Michael Krause, was based on Penny's alleged violation of Krause's Fourth Amendment rights. 42 U.S.C. § 1983. The jury awarded Krause $150,000, but the award was reduced by remittitur to $25,000. For the reasons that follow, we reverse...
