Defendant Danny Knight was convicted in a nonjury trial of driving while intoxicated in violation of RSMo § 577.010 (1986). Defendant had previously pled guilty to two alcohol related driving offenses. Defendant was sentenced to sixty days imprisonment or one hundred twenty days imprisonment with work release.
