O'BRIEN, Justice.

This appeal is from dismissal of a workers' compensation petition. The plaintiff suffered brain damage and is totally and permanently disabled. There are factual issues involved here and the scope of review by this Court is "de novo upon the record of the trial court, accompanied by a presumption of the correctness of the finding, unless the preponderance of the evidence is otherwise."
