Amoco Oil Company suffered a summary judgment dismissal of its indemnity claim against Chemlime Corporation when the district court ruled that the indemnity agreement, under which Chemlime is indemnitor and Amoco is indemnitee, did not satisfy the express negligence requirement under Texas law.
