Moreau commenced this litigation in 1982 against his employer, James River-Otis, Inc. (Company), for breach of contract, and against his local union, Local 247, and its international union, the International Brotherhood of Firemen & Oilers, AFL-CIO (IBFO) for breach of its duty of fair representation. The district court granted summary judgment in favor of the defendants, and dismissed the suit. On appeal, this court reversed and remanded...
