We have before us a petition for writ of habeas corpus and an appeal from the denial of relief pursuant to Florida Rule of Criminal Procedure 3.850. Robert Dale Henderson, who has filed the petition and appeal, is under sentence of death and under death warrant. We have jurisdiction. Article V, section 3(b)(1)(9), Florida Constitution.
