Plaintiffs in this legal malpractice action appeal from a judgment entered for defendant Soriano pursuant to ORCP 67 B, assigning error to the granting of that defendant's motion for summary judgment. Defendant filed a separate "protective" appeal from a judgment entered pursuant to ORCP 67 B for defendants Harvey and Inez Seim dismissing his cross-claim against them for indemnity.1
