OPINION

KENNEDY, Justice.

Appellant Richard Benavides was tried by a jury and found guilty of the aggravated robbery of Cliff Perez, a clerk in a convenience store, by the use of a firearm. The jury also found that appellant was a repeat felony offender and assessed punishment at confinement in the Texas Department of Corrections for forty-five years and a $5,000 fine.
