Earnest Fitzpatrick Jr. appeals his sentence of death. Fitzpatrick was originally convicted of first degree murder and sentenced to death for the April, 1980 shooting of Escambia County deputy Doug Heist. This Court affirmed the conviction and sentence, Fitzpatrick v. State, 437 So.2d 1072 (Fla. 1983), cert. denied, 465 U.S. 1051, 104 S.Ct. 1328, 79 L.Ed.2d 723 (1984).
