This is an original proceeding brought out of an action against relator by respondent Howard seeking damages for relator's negligence in failing to settle a claim against respondent Howard.

Relator, National County Mutual Fire Insurance Company, seeks the issuance of a writ of mandamus to compel the Honorable John Street: to enter an order abating the underlying case until an appeal presently pending before this court...
