In an Opinion reported at 646 F.Supp. 1067 (S.D.N.Y.1986), this Court held that as tax adviser and attorney to duPont, Brady "omitted material information when neither he nor his associate Gaven disclosed to their client their understanding that the IRS might well disallow the deduction [taken for the Kenona Coal tax shelter] prior to tax court review."
