STATEMENT OF THE CASE

Defendant-appellant, Benji Dean Loudermilk (Loudermilk), appeals his conviction by the Monroe Superior Court IV of possession of marijuana, a Class A misdemeanor under IND. CODE 35-48-4-11.

We reverse.
