Melvin J. Giepert brought this action alleging Judge Lorain Wingerter is not eligible to seek reelection because he is beyond the mandatory retirement age for judges of 70 years set out in Article V, sec. 23 of the Louisiana Constitution of 1974. The Civil District Court for the Parish of Orleans rendered judgment for Giepert and ordered Wingerter's name removed from the list of candidates.
