OPINION

REEVES, Justice.

This original mandamus proceeding arises from a denial by the trial court of relators' request for a trial by jury, following a late-filed jury demand. The controversy originated under Cause No. 88-CI-07043 in the 288th District Court of Bexar County, entitled San Antonio Auto Auction v. Calvin R. Brawner d/b/a Cal's Used Cars and Thomas A. Mills d/b/a Mills Motor Sales.
