Introduction

This is a suit by a career Marine Corps officer with 18 years of unblemished service, who contends that he was administratively separated from the service in violation of his Fifth Amendment Due Process rights. Plaintiff, William A. Andrews (Andrews), seeks a declaration of his rights, reinstatement to active duty at his prior rank, back pay to the jurisdictional limit of $10,000,
