This is an appeal from a summary judgment in an intentional tort suit. The plaintiffs are an employee and his wife, and the defendants are the employer and its insurer and two co-employees. Plaintiff was injured within the course and scope of his employment when he fell from a defective ladder. The ladder was bent, was missing a rung and had badly worn skid pads. Plaintiffs filed suit against defendants alleging that defendants knew or believed plaintiff...
