OPINION

CANTU, Justice.

The conviction is for murder. The punishment assessed by the same jury is a term of confinement for forty years and a fine of $5,000.00.

The salient facts reveal a shooting by appellant of his girl friend following an apparent lover's quarrel. The evidence further shows that appellant drove the wounded girl friend to a local hospital for treatment where she expired a short time...
