STEAGALL, Justice.

We issued the writ of certiorari to review the decision of the Court of Criminal Appeals in Lynn v. State, 543 So.2d 704 (Ala. Crim.App.1987), which affirmed Lynn's conviction for capital murder and the trial court's imposition of the death sentence. The writ was issued as a matter of right pursuant to Rule 39(c), A.R.App.P.
