Appellees record companies brought a copyright infringement action against appellants, charging that they rented copyrighted phonorecords without permission in violation of 17 U.S.C. § 109(b)(1),1 the "Record Rental Amendment." Appellants counterclaimed that the record companies violated the antitrust laws by lobbying for the Amendment and by conspiring to deny appellants...
