When the Burlington Northern Railroad acquired the St. Louis-San Francisco Railway in 1980, it had to provide for the protection of employees affected by the transaction. 49 U.S.C. § 11347. It negotiated with several unions, including the United Transportation Union (the Union), an agreement incorporating the New York Dock conditions, named after New York Dock Ry. v.
