Appellant, T.J. Hayes, was found guilty by a jury of capital felony murder, Ark.Stat.Ann. § 41-1501 (Repl.1977). The jury recommended a sentence of death by electrocution. The conviction was reversed by the Arkansas Supreme Court, and a new trial was ordered on the ground that the trial court should have allowed defense counsel access to records of Hayes' court-ordered psychiatric and psychological examinations.
